El 4 de julio de 2013, el Ministerio Publicó citó en calidad de testigo a comparecer por los hechos de violencia generados luego de las elecciones presidenciales del 14 de abril, al periodista Nelson Bocaranda, director del portal de noticias Runrun.es y conductor del programa La Cola Feliz, transmitido en Éxitos 99.9 FM, emisora del circuito privado Unión Radio. A la par, el diputado de la Asamblea Nacional, Pedro Carreño a acusó a Bocaranda de ser el “autor intelectual” de los sucesos violentos que se generaron en el país ante el descontento de los resultados electorales. El hecho ocurrió en Caracas, Distrito Capital.
Nelson Bocaranda informó a IPYS Venezuela que a su residencia ubicada en Caracas llegó la citación del Ministerio Público para comparecer ante la investigación que realiza el organismo judicial por los hechos de violencia presentados en abril, en la coyuntura poselectoral. Manifestó que la boleta llegó a su casa luego que la Fiscal General de la República, Luisa Ortga Díaz, anunciara el procedimiento en su cuenta en Twitter @Lortegadiaz. “El ciudadano Nelson Bocaranda ha sido citado para que comparezca la próxima semana ante la fiscalía 48 Nacional” (https://twitter.com/lortegadiaz/status/352905332177108994), escribió la autoridad judicial.
Pedro Carreño, en su cuenta en Twitter @PedroCarreno_e, replicó la información de la Fiscal General de la República y agregó que la citación a Bocaranda se realizaba como “autor intelectual”.
Horas antes, la Fiscal de la República mantuvo una reunión con la Comisión Mixta de la Asamblea Nacional -a la que pertenece Pedro Carreño- para abordar el avance de las investigaciones por los hechos de violencia postelectorales, en los que según la información oficial murieron 9 personas y 107 resultaron heridas. En el encuentro Ortega Díaz argumentó que en los días siguientes el Ministerio Público realizaría citaciones, imputaciones y medidas privativas de libertad, por este caso.
El llamado de la Fiscalía a Nelson Bocaranda era para el 9 de julio de 2013, sin embargo, el periodista informó que se encontraba fuera del país y que no podía acudir en esa fecha debido a inconvenientes con la adquisición de boletos para asistir a la cita. Afirmó que tan pronto pudiera comprar su pasaje, vendría al Caracas para declarar sobre esta situación.
Desde la fecha de la citación, Bocaranda no ha estado en la conducción del programa La Cola Feliz, que mantiene conjuntamente con Mariela Celis, en Éxitos 99.9 FM, que se escucha a nivel nacional.
Precedente
De acuerdo a los registros de IPYS Venezuela, el 16 de abril de 2013, Pedro Carreño, diputado del parlamento por el Partido Socialista Unido de Venezuela (PSUV), fuerza política oficial, anunció que solicitaría ante el Ministerio Público la congelacióln de las cuentas y la confiscación de los bienes del periodista Nelson Bocaranda luego de que el comunicador publicara en su cuenta en la red social Twitter un mensaje sobre la presunta presencia de cajas con votos de las elecciones presidenciales del pasado, en un Centro de Diagnóstico Integral (CDI).
“Informan que en el CDI de La Paz en Gallo Verde, Maracaibo, hay urnas electorales escondidas y los cubanos de allí no las dejan sacar”,decía el tweet que publicó Bocaranda. El periodista se refería a una supuesta irregularidad del material electoral de los comicios del 14 de abril. Los CDI son centros de salud que forma parte de la misión de salud Barrio Adentro, promovida por el gobierno nacional, en la que laboran médicos provenientes de Cuba.
En esa oportunidad, el diputado, además, acusó al periodista de ser responsable, por los presuntos daños causados a los centros médicos ambulatorios cobarde y advirtió que ejercería acciones penales contra el comunicador: “@NelsonBocaranda es responsable de daños a los CDI. Hoy en la AN aprobaremos exhorto al MP pera que le sea impuesta RESPONSABILIDAD PENAL” escribió el Diputado Carreño a través de su cuenta en Twitter. Añadió: “Dicha responsabilidad debe contemplar como pena acsesoria (SIC), la confiscación bienes y congelación de cuentas para resarcir el daño patrimonial”.
Versión oficial
En la publicación denominada “Víctimas de la arrechera: La violencia fascista en Venezuela del 15 al 19 de abril de 2013”, difundida por el Ministerio de Comunicación en Información en junio de 2013, en la que se ofrece una versión oficialista de los sucesos, se acusa a Bocaranda debido a que supuestamente su mensaje en Twitter “fue el detonante” para que iniciarán los presuntos ataques a los centros de salud de la red de Centros de Diagnóstico Integral.

Amenaza de acción legal
Ante estos señalamientos, la citación realizada al Ministerio Público a Nelson Bocaranda configura una amenaza de acción legal contra el periodista, lo cual pudiese derivar en una investigación penal por haber difundido información sobre los conflictos poselectorales. Las medidas judiciales son contrarias a los estándares internacionales de la libertad de expresión e información.

Caracas: Journalist subpoenaed to appear at court on account of post-election violent events
On July 4, 2013, the office of the government attorney subpoenaed journalist Nelson Bocaranda, director of the news portal Runrun.es and host of the program La Cola Feliz, broadcast through Éxitos 99.9 FM, a radio station of private radio circuit Unión Radio, as a witness to appear at court on account of violent events which happened after the April 14 presidential elections. At the same time, national assembly congressman Pedro Carreño accused Bocaranda of being the “intellectual author” of the violent events which took place nationwide expressing discontent for the election results. This happened in Caracas, capital district.
Nelson Bocaranda informed IPYS Venezuela that the subpoena issued by the office of the government attorney was sent to his home located in Caracas, to appear to the legal entity´s investigation on the post-elections violence which ensued in April. He stated that the writ arrived to his home after the attorney general of the republic, Luisa Ortega Díaz, announced it on her Twitter account @Lortegadiaz. “Citizen Nelson Bocaranda has been subpoenaed to appear next week at the national court No. 48” (https://twitter.com/lortegadiaz/status/352905332177108994), the judiciary authority wrote.
In his Twitter account @PedroCarreno_e, Pedro Carreño replied to the information broadcast by the attorney general of the republic and added that the subpoena to Bocaranda named him as the “intellectual author”.
Some hours prior to this, the attorney general of the republic held a meeting with the mixed committee of the national assembly – of which Pedro Carreño is a member – to broach the advance of the investigations on the post-election violent events, in which (based on the official data) 9 persons died and 107 were injured. At the meeting Ortega Díaz argued that in the following days the office of the government attorney would issue subpoenas, charges and accusations and measures to deprive the freedom of certain citizens regarding this case.
The attorney general´s subpoena to Nelson Bocaranda was for July 9, 2013, but the journalist informed he was out of the country and could not appear on that date due to inconveniences to purchase airplane tickets for that date. He stated that as soon as he could buy a ticket he would come to Caracas to give his declaration regarding this situation.
Since the date of the subpoena, Bocaranda has not hosted the program La Cola Feliz which he usually co-hosts with Mariela Celis on Éxitos 99.9 FM, broadcast nationwide.
Precedent
Based on the records kept by IPYS Venezuela, on April 16, 2013, Pedro Carreño, parliamentary congressman for the Partido Socialista Unido de Venezuela (PSUV), the official political party force, announced that he would request at the office of the government attorney the freezing of the accounts and seizing of the property of journalist Nelson Bocaranda after the communicator published in his Twitter account a message on the alleged presence of boxes with votes from the past presidential elections in an integral diagnostic center (CDI for its acronyms in Spanish).
“I have been informed that at the CDI of La Paz in Gallo Verde, Maracaibo, there are hidden election boxes and the Cubans who run the place are not allowing them to be taken out”,the tweet published by Bocaranda said. The journalist was referring to an alleged irregularity in the April 14 elections material. CDIs are healthcare centers which are a part of the healthcare mission called Barrio Adentro, promoted by the national government, in which doctors coming from Cuba work.
At that time the congressman also accused the journalist of being responsible for the alleged damages caused to the outpatient medical centers and called him a coward and warned that he would start criminal proceedings against the communicator: “@NelsonBocaranda is responsible for damages to the CDIs. Today at the AN we shall approve and exhort the MP to impose a CRIMINAL LIABILITY SUIT against him” congressman Carreño wrote on his Twitter account. He added: “This liability must contemplate as an accessory fine (SIC) the confiscation of the property and freezing of his accounts to repair patrimonial damages”.
Criminal actions
Along the same lines, two journalists in Mérida state have been subjected to criminal actions for broadcasting information on citizen protests rejecting the April 14 election results which occurred in that state. After a threat from governor Alexis Ramírez, Horacio Contreras, host of the program “Titulares de la Prensa¨ broadcast by Studio FM 102.7 FM and Leo León, reporter at ULA FM 107.7 and correspondent of El Nacional newspaper, were submitted to criminal investigations (http://ipys.org.ve/search.aspx?search=M%C3%A9rida+2013+accion+penal).
The official version
In a publication entitled “Víctimas de la arrechera: La violencia fascista en Venezuela del 15 al 19 de abril de 2013” (loosely translated as¨Victims of Anger: Fascist violence in Venezuela from April 15 to 19, 2013¨) , published by the Ministry of Communication and Information in June 2013, which offered an official version of the events, Bocaranda was accused since supposedly his message on Twitter “was the spark” that started the alleged attacks on the healthcare centers in the network of integral diagnostic centers.

Threats of legal actions
In light of these statements, the subpoena issued by the office of the government attorney on Nelson Bocaranda represents a threat of legal actions against the journalist, which could derive into a criminal investigation for having broadcast information on the post-election conflicts. These judiciary measures run counter to international standards on freedom of expression and information.
