Funcionario regional solicitó una investigación penal contra periodista por presunta difamación

El 04 de febrero de 2013, Francisco “Pancho” Pérez, columnista del diario El Carabobeño, asentado en Valencia, capital del centro costero estado Carabobo, denunció que fue demandado por ejercer su derecho a la libertad de expresión por el secretario de Gobierno de la entidad, Miguel Flores, perteneciente al oficialista Partido Socialista Unido de Venezuela (PSUV).

Aunque todavía no hay una notificación oficial al periodista, sus fuentes le confirmaron que el recurso en su contra fue remitido al Tribunal Segundo del Estado Carabobo, a cargo de la juez Lilian Tirado.

Pérez  comentó a IPYS Venezuela que la acción judicial es un nuevo ataque a su derecho a la libre expresión. La demanda se realizaría por presunta difamación e injuria agravada a un funcionario público.

El 14 de enero de 2012, en la columna En Secreta, publicada en El Carabobeño (este espacio se presenta todos los lunes, desde hace más de 30 años) Pérez aseguró que miembros del PSUV estaban lo señalándo de estar, supuestamente, implicado en el incendio, ocurrido el incendio del 1 de enero de 2013,  en el vertedero de basura de La Guásima, que sirve a los municipios metropolitanos de Carabobo. Lo señalan por presuntamente forzar una situación de emergencia y luego resolver el problema para obtener beneficios personales. Pérez negó que haya precisado qué tipo de beneficios obtendría el político, recién nombrado segundo al mando de la Gobernación de Carabobo.

Hasta el momento de la redacción de esta alerta de IPYS Venezuela, Pérez no había recibido ninguna notificación oficial del Tribunal. El Colegio Nacional de Periodistas, seccional Carabobo, emitió un comunicado de repudio a la acción legal que emprendió Flores, y alertó de los riesgos a la libertad de prensa que están renaciendo en la región.

A pesar de estas acciones de amedrentamiento, el periodista afirmó que seguirá escribiendo su columna semanal.

Es la segunda vez que “Pancho” Pérez es llevado a los tribunales por funcionarios públicos del oficialismo. El 11 de junio de 2010, el alcalde del municipio Valencia, Edgardo Parra, lo demandó por cargos similares. En ese entonces, el juez Alfredo Toredit Rojas lo condenó a tres años y nueve meses de prisión y lo inhabilitó para ejercer su profesión y optar a cualquier cargo de elección popular. El 30 de noviembre de ese año la sentencia fue anulada por un tribunal de apelaciones (/alerta?id=1672&y=2010&m=06).

Regional official demanded a criminal investigation against journalist for alleged defamation and libel

On February 4, 2013, Francisco “Pancho” Pérez, columnist of the newspaper El Carabobeño, based in Valencia, the capital of the coast center of Carabobo state, denounced that he was sued for exercising his right to freedom of expression by the state´s local government secretary, Miguel Flores, a member of the official party Partido Socialista Unido de Venezuela (PSUV).

Although no official notice has been received by the journalist, his sources confirmed that the complaint against him was sent to the second court of Carabobo state, headed by judge Lilian Tirado.

Pérez commented to IPYS Venezuela that the legal action is a new attack against his right to freedom of expression. The complaint was for alleged defamation and libel and aggravated grievance against a public official.

On January 14, 2012, in the En Secreta column published in El Carabobeño (presented every Monday since more than 30 years) Pérez stated that members of the PSUV were singling him out for allegedly being implicated in the fire of January 1^st, 2013 at the garbage dump of La Guásima, that attends to the needs of the metropolitan municipalities of Carabobo state. He is singled out for allegedly forcing an emergency situation and later solving the problem for personal gain. Pérez denied that he had stated what type of benefits the politician -recently designated the second in command at the Governor´s office in Carabobo- would obtain.

Up until the drafting of this alert by IPYS Venezuela, Pérez had received no official notice from the court. The National College of Journalists, Carabobo section, issued a communiqué repealing the suit filed by Flores, and alerted as to the risks to the freedom of press which is arising once again in this region.

Despite these intimidation tactics, the journalist affirmed that he shall continue writing his weekly column.

This is the second time that “Pancho” Pérez is taken to the courts by public officials which are members of the official political party. On June 11, 2010, the mayor of Valencia municipality, Edgardo Parra, sued him on related charges. Back then, judge Alfredo Toredit Rojas condemned him to three years and nine months in prison and banned him from exercising his profession and from presenting his candidacy to any position elected by the people. On November 30 of that year the sentence was annulled by an appeals court (/alerta?id=1672&y=2010&m=06).
