Presidente del parlamento solicitó sanción contra planta televisiva por interpretaciones a la Constitución Nacional

El 09 de enero de 2013, Diosdado Cabello, presidente de la Asamblea Nacional -máximo órgano del poder legislativo-; y Rafael Ramírez, ministro de Energía y Petróleo -cartera del poder ejecutivo, exhortaron a la Comisión Nacional de Telecomunicaciones (Conatel) a iniciar una investigación contra el canal privado de noticias Globovisión, por supuesta manipulación de la información ante el inicio de un nuevo período constitucional.

Cabello realizó este llamado a Contatel, dependencia de la Vicepresidencia de la República encarga de regular la actividad telecomunicacional del país, debido a que, a su juicio, Globovisión ha presentado una interpretación errada del artículo 231 de la Constitución de la República Bolivariana de Venezuela, el cual establece: “El candidato elegido o candidata elegida tomará posesión del cargo de Presidente o Presidenta de la República el diez de enero del primer año de su período constitucional, mediante juramento ante la Asamblea Nacional. Si por cualquier motivo sobrevenido el Presidente o Presidenta de la República no pudiese tomar posesión ante la Asamblea Nacional, lo hará ante el Tribunal Supremo de Justicia”.

Esta situación se presentó luego que Nicolás Maduro, vicepresidente de la República, enviara una comunicación, el 8 de enero de 2012, a la Asamblea Nacional en la cual notificaba que por “motivos sobrevenidos” Hugo Chávez, quien resultó reelecto, el 7 de octubre de 2012, como Presidente de la República Bolivariana de Venezuela, no podría asistir a la Asamblea Nacional a juramentarse para el nuevo período constitucional. Según la información oficial, el primer mandatario nacional se encuentra en un proceso de recuperación postoperatoria, tras ser sometido a la cuarta intervención quirúrgica, por la aparición de nuevas células cancerígenas.

La autoridad parlamentaria señaló que Globovisión refiere del artículo 231 de la constitución nacional “solo lo que les conviene a ellos porque son unas irresponsables y manipuladores. Ojalá, Conatel haga el procedimiento que corresponde para que aplique las sanciones por la manipulación de la verdad, por tratar de crear zozobra en la población, solo porque están cargados de odio -un odio mal sano además- hacía un ser humano, como lo es Hugo Chávez, y hacia el pueblo de Venezuela”. Estas declaraciones fueron ofrecidas durante un encuentro de Gran Polo Patriótico, coalición política en la que convergen fuerzas que simpatizan con el oficialismo, trasmitido en vivo por el canal estatal Venezolana de Televisión (VTV) desde el estado Aragua (http://www.dailymotion.com/video/xwmi73_diosdado-cabello-pide-a-conatel-abrir-procedimiento-adminstrativo-contra-globovision_news).

Estos planteamientos fueron respaldados por el Rafael Ramírez, ministro de Energía y Petróleo, durante un acto con trabajadores de la empresa estatal Petróleos de Venezuela, también transmitido en vivo por VTV, desde Caracas. Ramírez señaló: “estamos de acuerdo con presidente de la Asamblea Nacional, Conatel tiene que actuar en función de sancionar” a Globovisión por sus instigaciones. Ramírez enfatizó que, el 8 de enero de 2013, en esta planta televisiva calificaban que hay una “falta de legitimidad” del gobierno actual,  y se ha generado “un caos y una situación de desestabilización”.

Estas declaraciones configuran una amenaza de acción legal, y además, demuestran un uso abusivo del poder estatal, por parte de representantes del poder ejecutivo y legislativo, que tienen como efecto limitar el ejercicio de la libertad de expresión en el país.

President of the parliament requested to sanction a TV station for airing interpretations of the national constitution

On January 9, 2013, Diosdado Cabello, the president of the national assembly -the maximum entity of the legislative power- and Rafael Ramírez, the minister of energy and petroleum -part of the portfolio of the executive power, exhorted the National Telecommunications Commission (Conatel) to start an investigation against private news TV channel Globovisión, for allegedly manipulating information at the start of a new constitutional presidential period.

Cabello made this call to Conatel, ascribed to the vice-presidency of the republic in charge of regulating the nation´s telecommunications activities since, in his opinion, Globovisión has presented an erroneous interpretation of article 231 of the constitution of the Bolivarian republic of Venezuela, which sets forth that: “The male or female elected candidate shall be sworn in as the male or female president of the republic at the national assembly on the 10th of January of the first year of their constitutional period. If, for any reason whatsoever, the male or female president of the republic is unable to take possession of his post at the national assembly, he or she shall do so at the Supreme Court of Justice”.

This situation took place after Nicolás Maduro, vice-president of the republic, sent a communiqué on January 8, 2012 to the national assembly notifying that due to “unforeseen circumstances” Hugo Chávez, who was reelected on October 7, 2012 as the president of the Bolivarian republic of Venezuela, was unable to go to the national assembly to be sworn in for the new constitutional period. The official information stated that the nation´s head of state is completing his post-op recovery after his fourth surgery, due to the reappearance of cancer cells.

The parliamentary authority pointed out that Globovisión referred to the part in article 231 of the national constitution “only what is convenient to them because they are irresponsible and manipulative. We hope that Conatel follows the corresponding procedure and applies the due sanctions for manipulating the truth, for attempting to spread gloom and doom in the population, merely because they are filled with hatred -an unhealthy hatred to boot- towards a human being, such as Hugo Chávez, and towards the people of Venezuela”. These declarations were issued during a meeting of Gran Polo Patriótico, a political coalition where parties friendly to the official party converge, aired live by state TV channel Venezolana de Televisión (VTV) from Aragua state (http://www.dailymotion.com/video/xwmi73_diosdado-cabello-pide-a-conatel-abrir-procedimiento-adminstrativo-contra-globovision_news).

This proposal was backed by Rafael Ramírez, the minister of energy and petroleum, during an act with workers of state-owned company Petróleos de Venezuela, also aired live by VTV, from Caracas. Ramírez pointed out: “we agree with the president of the national assembly: Conatel must act and levy a sanction” on Globovisión for its instigations. Ramírez emphasized that, on January 8, 2013, this TV station stated that there is a “lack of legitimacy” of the current government and “chaos and a destabilizing situation” has been generated.

These statements constitute a threat of legal action, and also demonstrate an abusive use of the state´s power by representatives of the executive and legislative powers, the effect of which is to limit the exercise of freedom of expression in the nation.
